What Virginia’s Sexual Battery Statute Covers

Virginia Code § 18.2-67.4 classifies sexual battery as a Class 1 misdemeanor. The offense incorporates Virginia’s statutory definition of sexual abuse. That definition generally addresses intentional touching of intimate parts or material directly covering them, or forcing another person to engage in specified touching, with the intent required by law.

The statute identifies several circumstances that may support a charge:

  • Alleged sexual abuse against a complaining witness’s will by force, threat, intimidation, or ruse.
  • Specified repeated conduct involving one or more complaining witnesses during a two-year period.
  • Certain allegations involving authority-based relationships.

Virginia Code § 18.2-67.5 also classifies attempted sexual battery as a Class 1 misdemeanor. Prosecutors may pursue an attempt charge even when they allege the intended offense wasn’t completed.

How Sexual Battery Differs From Other Virginia Offenses

Sexual battery isn’t interchangeable with aggravated sexual battery, rape, or simple assault and battery. The appropriate charge depends on the alleged conduct, the complaining witness’s circumstances, any aggravating factors, and the elements the Commonwealth must prove. Simple assault and battery doesn’t require the same statutory sexual-abuse element, while aggravated sexual battery and rape involve different elements and potential penalties.

Penalties for Sexual Battery in Virginia

Under Virginia Code § 18.2-11, a Class 1 misdemeanor carries up to 12 months in jail and a fine of up to $2,500. The sentence in a particular case depends on the disposition, the evidence, the accused person’s record, and other circumstances considered by the court.

A conviction may also affect employment, professional licensing, housing, family relationships, and reputation. Sex-offender registration consequences require case-specific analysis because they depend on the applicable offense, disposition, criminal history, and separate statutory requirements. Not every sexual battery case carries the same registration consequences, making it important to understand the possible effects before entering a plea or making statements about the allegation.

How We Analyze the Evidence & Build a Defense

These cases often turn on specific details: what contact allegedly occurred, whether the required intent existed, how consent is described, whether accounts are consistent, and whether investigators obtained statements or evidence lawfully. We assess whether the Commonwealth can prove every statutory element beyond a reasonable doubt.

Potentially important evidence may include:

  • Communications: Text messages, emails, social media activity, call records, and other exchanges connected to the allegation.
  • Witness accounts: Statements from the complaining witness, the accused, and people who observed events before or after the alleged contact.
  • Timelines: Location information, recordings, receipts, photographs, and other records that may confirm or challenge an account.
  • Investigative materials: Interviews, reports, body-camera footage, search records, and information about how evidence was collected.

Our team includes former prosecutors and attorneys with experience as liaisons to law enforcement, in the U.S. Marine Corps, and in the intelligence community. That perspective helps us identify the prosecution’s theory, test the reliability of the evidence, and develop a strategy tailored to each client’s circumstances and goals.

Guidance From the Investigation Through Court Proceedings

We can intervene during a criminal investigation, explain whether questioning is voluntary, preserve useful material, and prepare you for upcoming court requirements. If charges are filed, we can review discovery, evaluate the statutory elements, communicate with prosecutors, assess plea proposals, litigate appropriate motions, and prepare for trial when necessary.

At Dischley Law, PLLC, we don’t apply the same response to every allegation. We can explain the accusation, potential consequences, available options, and next procedural steps so you can make informed decisions about your defense.
