How Drug DUI Charges Work Under Virginia Law

Virginia Code 18.2-266 covers both alcohol and drug impairment under a single statute. A DUID charge can arise under two distinct theories of liability, and understanding which one applies to your case shapes the entire defense strategy.

The Two Theories of Liability

The first theory is impairment-based: the Commonwealth argues that a drug, including a lawfully prescribed medication or even an over-the-counter product, impaired your ability to drive safely. The second is per se liability, where specific substances at or above statutory blood concentration thresholds result in a charge regardless of whether visible impairment was observed. Virginia’s per se thresholds include cocaine at 0.02 mg per liter of blood, methamphetamine at 0.1 mg per liter, PCP at 0.01 mg per liter, and MDMA at 0.1 mg per liter.

For marijuana, prescription drugs, and any substance without a defined per se limit, the prosecution must prove actual impairment through behavioral observations, field sobriety test performance, and blood results. Field sobriety tests are a weaker indicator of drug impairment than they are for alcohol, which is why law enforcement often supplements them with a Drug Recognition Evaluator (DRE), a specially trained officer who conducts a structured assessment designed to identify signs of drug influence at the scene.

Virginia’s Implied Consent Law & Blood Testing in DUID Cases

Under Va. Code 18.2-268.2, any driver arrested for a drug DUI in Virginia is deemed to have consented to chemical testing, provided the arrest occurs within three hours of the alleged offense. For alcohol-based arrests, the law requires a breath test as the primary test. For drug DUI arrests, law enforcement may require a blood test to determine the drug content of the driver’s blood.

Refusing the test carries real consequences. A first refusal is a civil offense resulting in 12 months of license revocation. A second refusal within 10 years is a Class 2 misdemeanor, carrying up to six months in jail and three years of license revocation.

Blood evidence also introduces multiple points where the defense can challenge reliability:

  • Collection technique at the time of arrest
  • Chain of custody from the scene to the laboratory
  • Storage conditions prior to analysis
  • Lab accreditation and adherence to required protocols
  • Testing accuracy for both substance identification and concentration measurement

Virginia law also gives defendants the right to have their blood sample independently tested by a lab of their choosing, which can provide critical comparative data.

These defenses matter because the penalties for a first-offense DUID conviction are significant. A Class 1 misdemeanor conviction carries a mandatory minimum $250 fine up to $2,500, up to one year in jail, a one-year license suspension, and ignition interlock as a condition of license restoration. Under Virginia Code 18.2-270, a third DUI offense within 10 years is a Class 6 felony carrying a mandatory minimum 90-day sentence, or a mandatory minimum six months if all three offenses occurred within five years.
