What Virginia’s Zero-Tolerance Law Actually Means

Virginia Code Section 18.2-266.1 makes it unlawful for any person under 21 to operate a motor vehicle after illegally consuming alcohol. The threshold is strikingly low: a blood alcohol concentration (BAC) of just 0.02% triggers a violation. The adult standard under Virginia law is 0.08%. That difference matters enormously in practice.

Unlike a standard DUI charge, the Commonwealth doesn’t need to prove the driver was impaired. The presence of a 0.02% BAC is enough. This offense is sometimes called “driving after illegally consuming alcohol,” or colloquially a “Baby DUI.” It is a Class 1 misdemeanor charged separately from Section 18.2-266, the adult DUI statute.

Penalties Under Virginia Code Section 18.2-266.1

A conviction carries consequences that go well beyond a fine. The court must impose a one-year forfeiture of the driver’s license from the date of conviction, and that suspension runs in addition to any administrative suspension already imposed under Section 46.2-391.2.

The mandatory minimums include either a $500 fine or 50 hours of community service. Eligible drivers may enroll in the Alcohol Safety Action Program (ASAP), an alcohol education and screening program required by the court. Completing ASAP can open the door to a restricted license during the suspension period, but only with an ignition interlock device installed for up to one year.

Virginia’s implied consent law, found at Section 18.2-268.2, adds another layer of exposure. Refusing a chemical test after a lawful arrest results in a separate one-year license suspension with no possibility of a restricted license during that period. It’s a decision worth discussing with an attorney before making.

Beyond the courtroom, a conviction creates a permanent criminal record. For young people in the Manassas area, that record can affect college admissions, scholarships, professional licensing, and employment. For those with ties to federal or defense employers throughout Northern Virginia, it can also affect future government employment and security clearances.

When an Underage Driver Faces Adult DUI Charges

The zero-tolerance statute isn’t always the charge. If an underage driver’s BAC reaches 0.08% or higher, or if the evidence shows impairment by alcohol or drugs regardless of BAC level, the charge moves to Section 18.2-266, the same statute used for adult drivers. Being under 21 provides no protection from adult DUI penalties at that threshold.

A first-offense adult DUI in Virginia is a Class 1 misdemeanor carrying potential jail time up to 12 months and fines up to $2,500, in addition to license suspension and other consequences. Virginia doesn’t distinguish between DUI and DWI under the statute. The terms are interchangeable. When the facts support a full adult DUI charge, the stakes are significantly higher, and the defense strategy needs to reflect that.

Juvenile Court vs. General District Court for Underage DUI

The driver’s age at the time of the offense determines where the case is heard. Drivers between 18 and 20 have their cases handled in Prince William County General District Court, the same as adult defendants. When the driver is under 18, the case typically goes to the juvenile and domestic relations district court, where parents or guardians participate directly as parties in the proceeding.

The juvenile court focuses on rehabilitation, but don’t let that create a false sense of security. Section 18.2-266.1 directs juvenile courts to impose the same disposition upon adjudicating delinquency as adult courts would, meaning the same license suspension and the same mandatory fine or community service apply. The setting is different; the consequences are not.
